Live Nation and Ticketmaster, two giants in the entertainment industry, have been ordered to face a class-action lawsuit over alleged pricing violations. Both companies, which have been accused of overcharging millions of event-goers across the United States, will now have to answer the claims in court. This lawsuit seeks to address alleged damages tied to the purchase of more than 400 million tickets over the past 15 years.
Details of the Lawsuit Against Live Nation and Ticketmaster
The class-action lawsuit was given the go-ahead by U.S. District Judge George Wu in Los Angeles. Live Nation had attempted to prevent the lawsuit from being certified as a class action but was unsuccessful. The class in question includes consumers who purchased tickets directly from Ticketmaster or a Live Nation affiliate for events at major venues since 2010.
The Beverly Hills-based company, Live Nation, was accused in the 2022 lawsuit of monopolizing ticketing services, enabling the company to charge artificially inflated prices in violation of antitrust law. Both Live Nation and Ticketmaster have since denied any wrongdoing.
Arguments from Live Nation and Ticketmaster
In their opposition to class certification, Live Nation and Ticketmaster argued that the individualized issues connected to tickets sold for 1,000 venues made it impossible to conduct a single trial on the plaintiffs’ allegations. According to Live Nation, it is the venues, not Ticketmaster, who set the fees paid by fans, often varying from show to show. However, in October, the U.S. Supreme Court declined to hear a bid by Live Nation and Ticketmaster to move the lawsuit out of federal court and into private arbitration.
Additional Antitrust Lawsuits Against Live Nation
It is worth noting that this is not the only antitrust lawsuit Live Nation is currently facing. The company is also dealing with an antitrust action filed in federal court in Manhattan by the U.S. Justice Department and a group of states. Similar to the class-action lawsuit, Live Nation has denied any wrongdoing in this case.
These lawsuits represent significant legal challenges for Live Nation and Ticketmaster. The outcomes could have wide-reaching implications for ticket pricing, the power balance between ticket sellers and venues, and the overall experience of concert-goers nationwide.
